We have examined the documents for the referenced condominium project for substantial compliance with the provisions of Chapter 718, Florida Statutes, and the related administrative rules. The documents are accepted for filing purposes. After the declaration has been recorded, the developer may close on contracts for sale or lease.
This acceptance is not an endorsement of the offering, development, or any representations made concerning this filing. It does not relieve the developer of any duty or responsibility under the Florida Statutes, the rules adopted by our division, or any other applicable laws. If we subsequently discover any deficiencies in the documents, we may require the developer to correct them.
This filing acceptance will automatically expire if the condominium or applicable phase has not been created within 24 months of the acceptance date. (Refer to rule 61B-17.005(3)(b), Florida Administrative Code.)
Within 45 days following receipt of this letter, the developer must file with the Division, in accordance with rule 61B-17.001(7)(e), Florida Administrative Code, a plain text integrated version of the filed documents in CD ROM format incorporating the initial filing with all changes necessitated by the Division’s examination process.
The developer is also required to file the recording information and correct mailing address for the association within 120 calendar days of recording the declaration of condominium.
